The V4Vans. website is operated by V4Vans.(“we”, “us” or “our”). By using the V4Vans.website you are bound by these terms and conditions. All use and applications made on this web site are governed by these Terms and Conditions at any time, although the Terms and Conditions governing any given use or application will be those in effect at the date of your application or specific use. If you use or submit applications after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each or use or application to ensure that you understand the precise terms and conditions applicable to your site visit or application. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date and time when these Terms and Conditions were most recently updated.

These terms and conditions apply between you and V4Vans.trading as V4Vans.for the acquisition of UK vehicles supplied by UK dealers and manufacturers.

General:

V4Vans.specialise in the sale of new (previously unregistered) and pre-registered (delivery mileage only) commercial vehicles. Used vehicles will be expressly described as such at point of sale. Unless expressly specified all vehicles are manufacturer UK standard specification.

The vehicle does not become the customer’s until it is paid for with cleared funds.

Website:

You may use anything on the V4Vans.website only for your personal information in connection with your business and for this purpose you may print, copy, download or temporarily store extracts from this website. You must not alter anything. Any other use is prohibited unless you first obtain our written permission. In particular, no-one may use any part of the V4Vans.website on any other website, or link any other website to this website, without our permission.

Prices:

The prices quoted exclude VAT and are for business users only. All other vehicle prices exclude Road Fund Licence and, First Registration Fee (where applicable) and also exclude Metallic Paint (where applicable).

V4Vans. reserves the right to change the price either before or after the client accepts any order. V4Vans. shall notify you of such a change and you have the right to cancel your order if the change is not acceptable.

Prices on the web site are for information purposes only and do not constitute an offer by V4Vans. capable of an acceptance by you.

Upon agreement by both parties and the relevant order form accepted by you, and after finance acceptance has been confirmed, a minimum deposit of £250 will be taken by credit/debit card, bank transfer, or cheque.

You will not have to pay V4Vans. for any credit brokerage services however we will receive payment(s) from the lender if you decide to enter into an agreement with them.

Quotations:

Vehicle quotations will remain valid for a period of 14 days, with the exception of:

Manufacturer introduced price changes

Changes in interest rates

Unforseen changes in marketing conditions

Changes to residual values made by our panel of funders

Data errors of miscalculation of the quotation(s)

Whilst every effort is made to ensure the validity of vehicle quotations V4Vans.reserve the right to withdraw quotations or vehicle orders supplied by V4Vans.to our customers without notice.

V4Vans.reserve the right to withdraw any quotation produced, either by a system based quotation, Verbal quotation or by electronic mail (Email) Post or Fax.

Specification and Images:

Whilst every effort is made to verify and ensure the accuracy of the data, the information should only be used as a guide and no purchasing decision should be made without verification of the latest data from either the manufacturer or franchised dealer. All images on the website are for illustration purposes only. The rates and vehicle data (including images, “standard equipment”, “factory fitted options”, “colour and trim” and “technical data”) contained in this web site are provided by a third party and are for information purposes only and – as such – cannot be relied upon.

Delivery/Registration:

Upon receipt of correct finance documentation and any balance of monies V4Vans. will arrange delivery of the vehicle to your chosen destination. Vehicles will not be delivered unless payment is received in full and funds have been cleared. Please make V4Vans aware if you wish to have the vehicle delivered whereupon a price can be obtained and quoted for. Title will not pass until full payment is received. Delivery dates are subject to change by the manufacturer but most orders are fulfilled in 10 – 14 working days. Information on “lead times” are estimates only and do not constitute an obligation to supply. Please note: All vehicles will be pre-registered unless otherwise stated and a retention period of the V5 Log book will be in force subject to the conditions laid out by the Fleet partner. Please be aware these retention periods of the V5 Log book alter from time to time but are generally anything from 6-12 months. If you wish to be made aware of the retention period of your vehicle or you would prefer to forgo the advantage of receiving enhanced Fleet terms, please enquire in writing prior to any order being placed with V4Vans.

Statutory Rights:

Nothing in these conditions shall affect your statutory rights.

V4Vans. is committed to customer service. Should you have any complaint about the V4Vans. service, we will endeavor to resolve them in a fair and effective manner.

Please inform V4Vans. by email at info@v4vans.co.uk should you have any complaints about our service. We are committed to acknowledging your complaint within 48 hours of receipt and undertaking all reasonable efforts to resolving it promptly under the circumstances. We will provide you with a timescale for resolving the dispute and keep you regularly updated with its progress.

Orders:

Your order of a vehicle from V4Vans. is an offer by you. All orders are subject to acceptance by V4Vans., availability, price changes and the payment of a deposit in accordance with your accepted order.

If the vehicle you have ordered is not available, V4Vans. will contact you by email or telephone to provide possible alternatives.

Deposits:

A minimum deposit will be required with every order to show the customer’s commitment to purchase, hire purchase or lease or contract hire the vehicle and V4Vans. commitment to supply the vehicle. Such a deposit, if it is accepted, will become a holding deposit and represent confirmation by the customer of the vehicle order and all terms and conditions.

If the customer fails to take delivery and pay the balance of the price without lawful reason by the agreed date, V4Vans. will be entitled to treat the agreement as cancelled by the customer and offer the vehicle for re-sale and claim from the customer any reasonable losses suffered which may include but are not limited to stocking charges, unrecoverable extras fitted to the vehicle, and any reduction in the value of the vehicle. V4Vans. will be entitled to use the deposit and any prepayment to reduce its reasonable losses. Any excess will be returned to the customer and any shortfall will be paid by the customer.

Credit/Debit card deposits represent payment of the holding deposit and the payment does not relate directly to the acquisition of the vehicle. The customer cannot claim from the Credit/Debit card companies in respect of Satisfactory Quality issues. Note the customer has the right to direct Satisfactory Quality issues to V4Vans. the funder and the supplying dealer/manufacturer. No credit card (or any other financial) details are stored by V4Vans.

Where a deposit has been paid against an order V4Vans will deem this deposit as being against quotes and general work carried out to secure the correct specification regarding the internal fit out, orders placed on our suppliers for components in relation to the Order, the external graphics as well as general administrative work. Should the order be cancelled by the Customer such Deposit is deemed as non-refundable. However, when the sale is completed the deposit will be deducted from the final invoice from V4Vans.

Part Exchange:

Any part exchange allowance agreed with a customer is usually based upon the customer’s description of the vehicle to V4Vans. In the event of subsequent damage to the vehicle, fair wear and tear expected, or if the customer knowingly gave incorrect information concerning the vehicle or has concealed a defect in the vehicle which V4Vans. relied upon, V4Vans.  may decline to take the vehicle, in which case V4Vans. will try to agree with the customer a new allowance. If no agreement can be reached the customer shall either pay the full price, or V4Vans.will be entitled to treat the agreement as cancelled by the customer.

Warranties:

Vehicles are supplied with the balance of the manufacturer’s warranty.

Upon delivery the customer signs the vehicle inspection form to agree that he/she is satisfied with the condition of the vehicle.

The customer must inform V4Vans. within a reasonable timeframe of any subsequent issues. V4Vans. will work with the customer to address the issues with the supplying dealer/manufacturer.

Cancellations:

Once a deposit is received V4Vans. will instruct suppliers and delivery agents to schedule delivery. This may incur costs that cannot be reversed. Consequently V4Vans. will make a minimum charge of £500 for all cancelled orders. Cancelled orders after delivery will result in a full refund less the standard delivery charge of £500.We will not be liable for any damages (including, without limitation, damages for loss of business projects, or loss of profits) arising in contract, tort or otherwise from the use of or inability to use the website, or any of its contents, or from any action taken (or refrained from being taken) as a result of using the V4Vans. website or any such contents. We make no warranty that the contents of the website are free from infection by viruses or anything else which has contaminating or destructive properties. We reserve the right to add to or change the terms of this agreement. Any changes will be posted to our web site and it is your responsibility as a user to refer to the terms on accessing this service. Changes will be effective 24 hours after first posting to the web site and you will be deemed to have accepted any change if you continue to access the web site after that time. The information that you provide us will be used by us for the effective administration of our services and to communicate with you. Further details are set out in the privacy policy. We shall have no liability to you for any interruption or delay in access to the V4Vans.website, irrespective of the cause. This ” V4Vans. website and these conditions are governed by English law. Any disputes arising from this website shall be resolved by the English courts unless you can show you accessed the website from Scotland, in which case the Scottish courts may be used. Certain trademarks and other materials used on the V4Vans. website are the copyright of V4Vans. All rights reserved. V4Vans. is responsible for the contents of this website.

Whilst every effort has been made to ensure the accuracy of the content of this website it is offered on an as is basis any errors or exceptions are accepted by the operator of the vehicle to which it refers.

Should a consumer have any rights under The Sale of Goods Act 1979 or the Unfair Contract Terms Act 1977 or the Unfair Terms in Consumer Contracts Regulations 1994 or any later amendments of these or any other relevant legislation and these rights conflict with these terms and conditions, then these rights shall prevail.

  1. The motor vehicle is sold as roadworthy, or subject to any defects notified by us to you and accepted by you, at the date of delivery and if any fault occurs you have the right to rely on your statutory rights. If you have any doubts about your statutory rights under the Sale of Goods Act 1979 or otherwise, please contact your local Trading standards Department or Citizens Advice Bureau.
  2. We will try to ensure delivery or the goods (“goods” in these Terms and Conditions is defined as our sales to you) by the estimated delivery date (if any) but cannot guarantee the delivery date.

Except where delay is caused by circumstances beyond our control you will be entitled to cancel the contract and receive repayment of your deposit if delivery has not taken place within 28 days of the estimated delivery date unless you have agreed otherwise, orally or in writing to accept late delivery.

Where delay is caused by circumstances beyond our control we will not be liable for any damages related to the delay and in these circumstances we will contact you and agree an alternative date for delivery or you may cancel the contract, in which case any deposit paid by you shall be returned in full.

  1. If the manufacturer of the goods described in the contract stops making goods of that type, we may (whether the estimated delivery date has arrived or not) give you written notice to cancel the contract. Any deposit you have paid to us will be returned to you.
  2. If you fail to take and pay for the goods within 21 days of notification that the goods are available for delivery, we may treat the contract as cancelled and keep any deposit paid by you.
  3. The goods shall remain our property until the price has been paid in full. Where payment is made by cheque the goods will remain our property until the cheque has cleared. Payments made by credit card shall incur a 3.0% charge and any such transactions made using credit or debit card facilities shall be limited to £500.00.

The proceeds of any goods re-sold by you prior to the cheque having cleared are to be held by you in trust for us. The risk in the goods passes to you when you take delivery.

  1. If the goods by us are new, the following provisions shall have effect:

Please be aware that vehicles described as “New” are registered to our partners to obtain maximum discount which in turn is passed on you the customer. Manufactures vary, but the retention period can by anything from 3 -12 month transferring the “Registered Keeper” status to you the customer after this time. During any such retention period should the vehicle incur fixed penalty charges for speeding, congestion charges or the like the issuing authority will communicate with Vantastic4vans or our partners as the registered keeper. Vantastic4vans Limited shall be happy to administer the paperwork for one such a charge on a free of charge basis. Any subsequent charge notices shall incur an additional £25 handling fee from V4vans which you, the Customer agree to settle upon demand within 7 days of our invoice date. Should you require to be the first registered keeper then notice should be given at the time of enquiry to ensure correct quoting in line with reduced bonus levels.

  1. a) We undertake to ensure that the pre-delivery work (factory fitted) specified by the Manufacturer or Importer is carried out and that we will use our reasonable endeavours to obtain for you from the Manufacturer or Importer the benefit of any warranty or guarantee given by them to us. These warranties or guarantees are in addition to and not in replacement of any warranties or guarantees given to you by us.
  2. b) No allowance can be made for any part of the standard equipment supplied with the motor vehicle, which you do not wish to take.
  3. c) If, after the date of this order and before delivery of the goods to you, the Manufacturer’s or Importer’s recommended price for any of the goods is changed, we shall give notice of any change to you and:

(i) If the Manufacturer’s or Importer’s recommended price for the goods is increased you will be notified of the amount of the increase we intend to pass on to you. You have the right to cancel the contract within 14 days of receipt of this notification.

If you do not cancel the contract the increase in price shall be added to and become part of the contract price.

(ii) If the recommended price is reduced you will be notified of the amount of the reduction we intend to pass on to you. If the amount passed on to you is not the same as the reduction of the recommended price you have the right to cancel the contract within 14 days of receipt of this notification. if you do not cancel the contract the reduced price will be the contract price.

  1. d) If you cancel the contract because of a price change notified by us to you, any deposit which you have paid to us will be returned to you.
  2. Any correspondence to you will be sent by normal post or by e-mail rather than registered delivery, to the relevant address you have provided. If you subsequently move address you should notify Vantastic4vans of your contact detail
  3. If you arrange a finance company to purchase the goods from us, we shall tell the finance company how much money has been agreed by us to be deducted from the purchased goods by form of deposit paid to us.
  4. Should either you or we not strictly enforce any obligation under this agreement at any time, this will not prevent that obligation being enforceable at a later date.
  5. V4ans are unable to offer any warranty for items fitted to the vehicle which give indication of or are the effect of interference by any third party other than authorised repair agents appointed by V4vans.
  6. Any amendments or changes with the internal fitment of the vehicle undertaken by any party other than those specifically authorised by V4 Vans will invalidate any warranty claim you may have with the vehicle and will not be compensated.
  7. Any requests made for queries or issues with the vehicle interior or exterior whatsoever should be put in writing only to info@V4vans.co.uk,a call out charge of £200 will be taken in advance of a visit. This will be refunded if the issue is one which is included as a warranty matter.
  8. Should there be any issue with the mechanical running of the vehicle then Roadside Assistance should be called directly the details can be found in the vehicle handbook. V4Vans recommend that the Customer takes out additional Roadside Assistance which extends beyond that provided by the Manufacturer.
  9. Replacement parts. Where a replacement part is called for by the Customer, prior to any inspection and testing being carried out by V4V or their appointed agents then a securing, one off charge of £100 will be called for against a credit or debit card. Upon inspection by our appointed representative and report received that indicates a component failure of the original part no charge will be made.
  10. Should a claim wish to be made, then reasonable access to the vehicle during normal office hours must be allowed to V4Vans or our agents for inspection of the vehicle and it’s component parts for any warranty claims to be considered. Normal office hours are defined as Mon-Fri 8.30am to 5pm
  11. V4Vans reserve the right to refer any failures to a third party of their choice for investigation and report. In the event of such a report finding no fault with any component or reasonable evidence of outside interference V4Vans reserve the right to levy charges for such call outs.
  12. “Consequential loss” shall mean loss of profits, contracts or other consequential loss or damages whatsoever that is believed to be or as a matter of fact has been bought about by the failure of the vehicle or any of the component parts or fitments.
  13. Where V4Vans have, under your instruction, carried out modifications or internal conversion work then this shall be warranted by V4Vans for a period of 12 months. Should any of the vehicle components, whether manufacturer fitted or those fitted by V4vans be altered, added to or adapted in any way then such Warranty cover may be withdrawn.

Nothing in these terms and conditions shall make V4vans liable for any consequential loss to the customer including any expense liability loss claim or proceeding whatsoever caused by or arising out of the late delivery, non delivery, unsuitability, incompatibility or failures of component parts within or without of the vehicle or off the equipment or any part thereof or any breakdown or stoppage of the same that shall be covered by the Warranty on such parts or components.

V4vans would recommend that where the Goods (the van) are an important part of your ability to continue your business then adequate insurance should be taken out to cover any time the vehicle is off for the road for rectification or repair work to be undertaken.

Your signature is taken as your agreement and acceptance of these terms and that you accept the hand over has been carried out to your satisfaction.
